Terms of Service
Last updated: October 12, 2026 · Draft pending review
1. Agreement
These Terms of Service ("Terms") govern access to and use of TruckerGuard AI websites, trials, subscriptions, and software (the "Service"). By creating an account, starting a trial, contacting sales, clicking accept, or using the Service, you agree to these Terms on behalf of yourself and the company you represent ("Customer"). If you do not agree, do not use the Service.
2. The Service
TruckerGuard provides software tools for trucking operations, including fleet, compliance, dispatch, safety, documents, and related modules. Features may vary by plan. We may modify, add, or remove features with reasonable notice when material. Beta or preview features may be incomplete and are provided as-is.
3. Accounts and eligibility
You must provide accurate registration information and keep credentials confidential. Customer is responsible for activity under its accounts and for authorizing only appropriate users (Owner/Admin, safety, dispatch, drivers, etc.). You must be at least 18 and able to form a binding contract. Self-serve plans may start with a limited trial; enterprise plans may require Contact Sales.
4. Customer data and responsibilities
Customer retains ownership of data it submits to the Service ("Customer Data"). Customer grants TruckerGuard a limited license to host, process, and display Customer Data solely to provide and improve the Service, including backups and security. Customer is responsible for the accuracy and legality of Customer Data, for obtaining required consents from drivers and other individuals, and for using the Service in compliance with FMCSA and other applicable laws. TruckerGuard is a software platform — not legal counsel, and not a substitute for Customer’s compliance obligations.
5. Acceptable use
Customer will not: (a) misuse the Service or attempt unauthorized access; (b) reverse engineer except where prohibited from restriction by law; (c) upload malware or unlawful content; (d) interfere with other customers; (e) resell the Service without our written consent; or (f) use the Service to violate law or third-party rights.
6. Subscriptions, trials, and fees
Paid plans renew according to the selected billing period unless canceled. Trials may convert to paid access when Customer adds payment; payment is collected by our processor (e.g., Stripe). Fees are non-refundable except where required by law or expressly stated. Taxes may apply. We may change prices with notice for the next renewal period.
7. Cancellation, deactivation, and termination
Subscription cancellation is separate from account termination.
• Cancel subscription: Customer may cancel a paid subscription so it ends at the close of the current paid period. Access may continue until that date; afterward the account may be automatically deactivated.
• Deactivate: Temporary and reversible. Portal access is blocked; Customer Data and history remain stored; Super Admin may reactivate.
• Terminate: Permanent closing of the account for access. The account is no longer active or accessible; historical and compliance data remain archived under our retention policy rather than being immediately deleted.
We may suspend or terminate access for non-payment, breach, legal risk, or misuse. Sections that by nature should survive (including data ownership, confidentiality, limitation of liability, and indemnities) survive termination.
8. Confidentiality
Each party may receive confidential information from the other. The receiving party will protect it with reasonable care and use it only for purposes of the relationship, except for information that is public, independently developed, or required to be disclosed by law.
9. Intellectual property
TruckerGuard and its licensors own the Service, software, branding, and documentation. No rights are granted except as expressly stated. Feedback you provide may be used to improve the Service without obligation to you.
10. Third-party services
The Service may integrate with third-party products (ELD, fuel cards, load boards, payment processors, etc.). Those services are governed by their own terms. We are not responsible for third-party outages or data practices beyond our contractual role as a processor/connector.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET EVERY REGULATORY OUTCOME FOR YOUR FLEET.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKERGUARD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER TO TRUCKERGUARD FOR THE SERVICE IN THAT PERIOD (OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID).
13. Indemnity
Customer will defend and indemnify TruckerGuard against claims arising from Customer Data, Customer’s misuse of the Service, or Customer’s violation of law or these Terms, except to the extent caused by our willful misconduct.
14. Privacy
Our Privacy Policy explains how we handle personal information and is incorporated by reference. By using the Service you acknowledge that policy.
15. Governing law
These Terms are governed by the laws of the State of [STATE — insert before go-live], excluding conflict-of-law rules. Courts in [COUNTY/STATE — insert before go-live] will have exclusive jurisdiction, except where prohibited.
16. Changes to Terms
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance, except where applicable law requires additional consent.
